1. Personal Information

If you engage in my services via the Etsy shop, website, or Gurucan, New Zenler platforms I use for courses then you agree with the statement in this policy. Please note this privacy policy also applies if you share any information with me if I meet you in person during an event or workshop.
To fulfil your order, you must provide me with certain information (which you authorised Etsy to provide to me if you have gone directly through Etsy), such as your name, photo, email address, postal address, payment information, and the details of the product that you’re ordering. As well as providing me with additional personal information (for a custom order of a portrait). This you would do through Etsy or my contact form via my website www.janinerosekeall.com  for the purpose of helping me to connect with the spirit being or aspect you have ordered and to help me provide a reading if you have requested this.

2. Why I Need Your Information and How I Use It

I rely on a number of legal bases to collect, use, and share your information, including:
as needed to provide my services, such as when I use your information to fulfil your order, to settle disputes, or to provide customer support;
when you have provided your affirmative consent, which you may revoke at any time, such as by signing up for my mailing list via my website;
if necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases if required by tax law; and
as necessary for the purpose of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as 1) providing and improving my services. I use your information to provide the services you requested and in my legitimate interest to improve my services; and 2) Compliance with the Etsy, New Zenler or Gurucan Seller Policy and Terms of Use. I use your information as necessary to comply with my obligations under the Etsy Seller Policy and Terms of Use.

Information about my customers is important to my business. I share your personal information for very limited reasons and in limited circumstances, as follows:
Etsy. I share information with Etsy, New Zenler or Gurucan as necessary to provide you my services and comply with my obligations under both the Etsy, New Zenler or Gurucan Seller Policy and Terms of Use.

I engage certain trusted third parties to perform functions and provide services to my shop, such as Royal Mail (to send your orders by the address you provide) I will only share your personal information with these third parties, but only to the extent necessary to perform these services.
Business transfers. If I sell or merge my business, I may disclose your information as part of that transaction, only to the extent permitted by law.
Compliance with laws. I may collect, use, retain, and share your information if I have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others. Please note for marketing and promotion purposes I do share the portraits I draw on social media, however I do not share any of your personal details on the posts, it would be just be about the spirit being or aspect drawn and I would inform you of my intention to do this anyway. Any objections from you about doing this I would respect and not use for marketing and promotion work.

4. Data Retention

   I retain your personal information only for as long as necessary to provide you with my services and as described in my Privacy Policy. However, I may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements. Normally I would only keep details of your conversations, email address etc with me until your order is complete and shipped off then delete once this is done. Please read Etsy, Zenler or Gurucan privacy policy in regards to your details retained for payment transactions and account as well as the privacy policy of the payment system you wish to use.

5. Transferring of information outside the EU

   Whether you live in the EU or outside the transfer of information is the same process. All information I receive from you will be processed and stored through Etsy, New Zenler, Gurucan or the email used via contact form on my website which are secure servers that are managed by me and the service providers which is subject to security and access controls using username and password authentication.

   6. Your Rights

   If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. I describe these rights below:
